The Pier is a community initiative operated by Ariv, which is the legally registered entity behind this platform. Throughout this policy, “The Pier” refers to the community, while “Ariv” remains the official business entity responsible for its operation.
Your access to our services is subject to your acceptance, without modification, of all the terms and conditions contained herein and all other operating rules and policies published and that may be published from time to time by us.
Please read the Agreement carefully before accessing or using our Services. By accessing or using any part of our Services, you agree to be bound by these Terms. If you do not agree to any part of the terms of the Agreement, then you may not access or use our Services.
The Pier community is restricted to individuals aged 18 years and over.
Members should avoid sharing personal information that could identify themselves, such as the names of family members, specific locations, or other unique identifiers. If another member shares such information, whether intentionally or accidentally, it is your responsibility to treat it as confidential and not disclose it elsewhere.
Members must respect the confidentiality of others by not sharing any personally identifying details shared within The Pier community outside of the platform. Breaching confidentiality may result in account termination or other actions deemed appropriate by community administrators to maintain a safe and respectful space.
By maintaining confidentiality, you contribute to fostering a safe and respectful environment for all members.
Users must engage respectfully and in alignment with The Pier’s community values (respect, compassion, mindfulness, and authenticity). Violations, including harassment, spam, or inappropriate language, may result in account suspension or termination.
The Pier does not provide crisis support or clinical mental health services. If you are in crisis or require immediate assistance, please contact Lifeline at 13 11 14 or visit lifeline.org.au. For international resources, refer to befrienders.org.
The Agreement does not transfer from us to you any of our or third-party intellectual property, and all rights, title, and interest in and to such property will remain (as between the parties) solely with The Pier and its licensors.
In using the Services, you may use third-party services, products, software, embeds, or applications developed by a third party (“Third-Party Services”).
If you use any Third-Party Services, you understand that:
You are responsible for maintaining the security of your account and ensuring that your credentials are not shared or misused. Any activity conducted under your account is your responsibility. You must keep your account information accurate and up-to-date, and notify us immediately if you become aware of any unauthorised access or security breaches.
Our Service may contain links to third-party websites or services that are not owned or controlled by The Pier.
The Pier assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. The Pier shall also not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such websites or services.
We advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.
We reserve the right to suspend or terminate any account that violates these Terms or disrupts the community space. In most cases, we will provide notice before taking action, unless immediate removal is necessary to maintain the safety and integrity of The Pier.
If you wish to terminate the Agreement or your account at The Pier, you may simply discontinue using our Services.
All provisions of the Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Our Services are provided on an “AS IS” and “AS AVAILABLE” basis. The Pier and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement. Neither The Pier, nor its suppliers and licensors, makes any warranty that our Services will be error-free or that access thereto will be continuous or uninterrupted.
You understand that you download from, or otherwise obtain content or services through, our Services at your own discretion and risk.
Except where otherwise required by law, the Agreement and any access to or use of our Services will be governed by the laws of Australia. The proper venue for any disputes arising out of or relating to the Agreement and any access to or use of our Services will be the courts located in Victoria, Australia.
The Pier reserves the right, at our sole discretion, to modify or replace these Terms at any time.
If we make changes that are material, we will let you know by posting on our website, or by sending you an email or other communication before the changes take effect. The notice will designate a reasonable period of time after which the new terms will take effect.
We will try to provide at least 30 days’ notice prior to the effective changes. If you disagree with our changes, then you should stop using our Services within the designated notice period, or once the changes become effective.
Your continued use of our Services will be subject to the new terms.

We understand that privacy is important to members of our community, especially in a peer support space. This statement governs our privacy policies with respect to those users of the Site (“Visitors”) who visit without transacting business and Visitors who register to transact business on the Site and make use of the various services offered by The Pier (collectively, “Services”) (“Members”).
“Personally Identifiable Information” refers to any information that identifies or can be used to identify, contact, or locate the person to whom such information pertains, including, but not limited to, name, address, phone number, fax number, email address, financial profiles, social security number, and credit card information. Personally Identifiable Information does not include information that is collected anonymously (that is, without identification of the individual user) or demographic information not connected to an identified individual.
We may collect basic user profile information from all of our Visitors. We collect the following additional information from our Members: name and email address.
In addition to our direct collection of information, our third-party service vendors (such as credit card companies, clearinghouses, and banks) who may provide such services as credit, insurance, and escrow services may collect this information from our Visitors and Authorised Customers.
We do not control how these third parties use such information, but we do ask them to disclose how they use personal information provided to them by Visitors and Authorised Customers. Some of these third parties may act solely as intermediaries in the distribution chain and do not store, retain, or use the information given to them.
Personally Identifiable Information (PII) refers to any information that can be used to identify or contact an individual. The Pier collects only the minimum required information needed to create a membership account and maintain a safe and supportive community.

Members may also choose to share additional profile information within the community, but this is completely optional and at their discretion.
How We Use Your Information:
Members can adjust their email preferences or opt out of non-essential emails at any time.
Personally Identifiable Information about Members may be shared with other Members who wish to evaluate potential transactions with other Members.
We may share aggregated information about our Visitors, including the demographics of our Visitors and Authorised Customers, with our affiliated agencies and third-party vendors. We also offer the opportunity to “opt out” of receiving information or being contacted by us or by any agency acting on our behalf.
Personally Identifiable Information collected by The Pier is securely stored and is not accessible to third parties or employees of The Pier except for use as indicated above.
Visitors and Authorised Customers may opt out of receiving unsolicited information from or being contacted by us and/or our vendors and affiliated agencies by responding to emails as instructed or by contacting us at contact@ariv.com.au.

We also use Cookies for security purposes to protect our Authorised Customers. For example, if an Authorised Customer is logged on and the site is unused for more than 10 minutes, we will automatically log the Authorised Customer off.
Visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using https://thepier.community, with the drawback that certain features of the website may not function properly without the aid of cookies.

The Pier uses login information, including, but not limited to, IP addresses, ISPs, browser types, browser versions, pages visited, and the date and time of visits to analyse trends, administer the Site, track a user’s movement and use, and gather broad demographic information.
The Pier is hosted on SiteGround, which may store website-related data as part of standard hosting operations. However, SiteGround does not access or process Personally Identifiable Information beyond what is required for website functionality and security.
Currently, The Pier does not share Personally Identifiable Information with any partners, vendors, or service providers. If this changes in the future, for example, through funding partnerships or external service providers, we will update this Privacy Policy and notify members accordingly.
All of our employees are familiar with our security policy and practices. The Personally Identifiable Information of our Visitors and Authorised Customers is only accessible to a limited number of qualified employees who are given a password to gain access to the information.
We audit our security systems and processes regularly. Sensitive information, such as credit card numbers or social security numbers, is protected by encryption protocols to protect information sent over the Internet. While we take commercially reasonable measures to maintain a secure site, electronic communications and databases are subject to errors, tampering, and break-ins, and we cannot guarantee that such events will not occur.

Membership in The Pier is for individuals aged 18 and older. We do not knowingly allow children under 18 to join the community.
Our Service does not address “Children,” anyone under the age of 18 years, and we do not knowingly collect personally identifiable information from children under 18 years.
If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us immediately. If we come to know that children under 18 years have provided personal information, we will delete the information from our servers immediately.
We will disclose Personally Identifiable Information in order to comply with a court order or subpoena or a request from a law enforcement agency to release information. We will also disclose Personally Identifiable Information when reasonably necessary to protect the safety of our Visitors and Authorised Customers.
We will notify members via email or an in-platform announcement if there are significant changes to this policy.
